COMMUNICATIONS LAW SOCIETY


The Communications Law Society is a student organization that aims to promote professionalism and career development by bringing well-known practitioners to on-campus panels to provide advice and real-world application in the communications law field. Activities also include a mentoring program, a job bank, student advising sessions, and field trips to the Museum of Radio and Television and other media conglomerates. During the spring semester, members of the society participate in the National Telecommunications Moot Court Competition held in Washington, D.C.

INDEPENDENT RESEARCH

Students interested in transnational media and communications law are strongly encouraged to conduct independent research under the supervision of a full-time faculty member. Past projects include Russian media law and policy, satellites in the former Soviet Union, regulatory responses to the convergence of digital technologies in the European Union and the United Kingdom, V-chip and censorship and protection of minors on television, and information intervention in Bosnia-Herzegovina, Cambodia, East Timor, Kosovo, and Rwanda.

This seminar will analyze the common law and statutory doctrines that govern the employer-employee relationship as they have developed in response to new technologies,

This seminar will analyze the common law and statutory doctrines that govern the employer-employee relationship as they have developed in response to new technologies, forms of organization and shifts in political power. For students who have not previously taken labor or discrimination law, this course will provide an overview of employment law. For those who have taken these courses, this will provide an opportunity to place these specific statutory schemes in a broader context and pragmatically address workplace issues. We will explore the range of common law approaches (employment at will and contract doctrines; tort issues of defamation, privacy, discharge in violation of public policy, and the duty of loyalty), and the different statutory models of labor regulation (Norris-LaGuardia Act, Labor Management Relations Act, Railway Labor Act). The course will also emphasize employment discrimination (race, sex and national origin (Title VII); age; and disability) and employment benefit regulation (minimum wage/overtime, pension/health insurance, and family care/medical leave).

The seminar explores legal problems in connection with the administration of government welfare programs, particularly programs providing cash benefits (such as Social Security) and medical benefits (such as Medicare and Medicaid). Role of litigation and other means of advocacy; techniques of effective advocacy; professional responsibility of the public interest lawyer. Students participate in exercises, drawn from cases being handled by the Bet Tzedek Legal Services Clinic, in the technique of civil litigation including interviewing and counseling, drafting of pleadings, handling pretrial discovery such as depositions and interrogatories, pretrial motion practice, handling trials and hearings, and negotiating appropriate relief. Open only to students in the Bet Tzedek Clinic or the Bet Tzedek Community Services Clinic.

Rapid changes in technology also present intriguing issues for scholarly and judicial debate, making this area particularly well suited to introducing students to ways of thinking about and analyzing case law, statutes, and law review articles.Areas of Study include comparative approaches to media ownership regulation, Internet jurisdictional issues, child protection and censorship, HDTV development, international standards, and privatization and deregulation of public broadcasting entities.In addition to Cardozo professors, past faculty include a distinguished group of media law professors and practitioners around the world, such as Jack Balkin, Yale Law School; Angela Campbell, Georgetown University Law Center; Bernd Holznagel, Münster University, Germany; Mark Stephens, leading media law specialist in England; and Stefaan Verhulst of University of Oxford.The program includes guest lectures and trips to London. Participants include students from Austria, Germany, Hungary, Hong Kong, Macedonia, Mexico, Romania, Russia, Serbia, Tajikistan, and Uzbekistan. Some students have secured summer jobs in London in conjunction with the summer program.

The United States has always been a land of diversity. Most people in this country embrace the diversity that makes up the spectrum of Americans. There are people with ancestry from every part of the world who consider themselves Americans. Historically, the U.S. has been seen as a "melting pot" where people from all countries and all social and economic levels blend together to form a single diverse population.
The influx of diverse peoples into the American melting pot is achieved through immigration. There have been periods within U.S. history when immigration took on distinct characteristics. There were periods when the greatest number of immigrants came from western European countries, or when large numbers of refugees came to the U.S. to escape persecution or poverty following wars or famines. Currently, immigration is truly heterogeneous. We have people coming from all countries and from all walks of life. We have seen large numbers of applicants from India, China, Nigeria, Bangladesh, and Pakistan. This should not be a surprise since each of these countries has a huge population. However, we also see applicants from countries with small populations such as Nepal, Sweden, and Trinidad.
U.S. immigration law provides advantages for people in various professional fields, including the sciences, medicine, engineering, business, the arts, and athletics. The U.S. government has recognized that issuing a green card to a person from another country is not only a benefit to that person, but also to the U.S. because we, as a people, will benefit from the intellectual, social, professional, scientific, medical, and cultural uniqueness that accompanies each new member of this country.

WORKING IN THE U.S. AFTER EXPIRATION OF THE OPTIONAL PRACTICAL TRAINING



If the foreign student plans to stay in the U.S. and continue working for the employer beyond the initial optional practical training year, then an H-1b visa will be required. Prior to 1997, we used to recommend that a foreign student not to bother with the H-1b application until four months or so before the expiration of the optional practical training. However, things changed in 1997 when the H-1b limit was reached in August. This year the limit was reached much earlier in the month of May. Despite the fact that the number of H-1b visas available has been dramatically increased over the next three years, it would be prudent to begin the H-1b process as soon as possible to prevent situations where the optional training has expired while the H-1b is under process. have received literally thousands of letters, faxes, and e-mails from people interested in immigration over the past five years. Within those communications are numerous questions about the immigration process. Not surprisingly, many people ask the same questions. I will discuss several of the most common questions I receive below. I am always willing to discuss these or other questions in more detail.
Question #1: How long will it take to obtain a green card?
Answer: It is impossible to give a precise estimate of time because there are several variables, some of which are independent of the attorney's work. The client will need to obtain copies of items in the c.v. The INS Service Center will determine the average time required for the type of visa sought, but this can change at different times. Presently, the INS Vermont Service Center is saying 60-120 days (closer to 120 days) to process an I-140 (green card) application. The Northern Service Center is presently at 185-215 days, so you can see that there is a great deal of variation. Then, adjustment of status or consular processing took 3-7 months in the past, depending on several factors. However, the adjustment of status can now take 10-14 months due to INS slowdowns. It is best to ask the attorney at the time the application procedure is initiated for his best estimate, but please remember that this is only an estimate.

University of Oxford - international students

Through a special arrangement with the University of Oxford, students in the Squadron Program can spend a semester with the Programme in Comparative Media Law & Policy, conducting research for credit under the supervision of the director of the Programme. As registered students of St. Peter’s College at Oxford, students attend classes in intellectual property and EU competition law and can participate in weekly seminars held at the Centre for Socio-Legal Studies at Wolfson College. Recent seminars include "Eastern European Media, Civil Society and Democracy," "Media Intervention in Conflict and Post-Conflict Environments: A New Kind of War," "Psychological Operations and Information Warfare," "Security on the Internet," "E-commerce and Regulatory Arbitrage—Shopping for Infrastructure Providers in a Global Economy," "Intellectual Property as Price Discrimination within an E-Commerce Setting," "India's response to Convergence of Broadcasting, Telecommunication and Information Technologies," and "The Digital Future of the BBC."

OBTAINING THE I-20


The I-20 is the INS form that a school must issue to a foreign student to enable him/her to go to the nearest United States consulate to obtain the F-1 student visa. The I-20 will only be issued by the school after the student is admitted to the school and the necessary financial proof has been made to demonstrate that the student will have enough funds for tuition and living expenses for the duration of the educational program. HEALTH INSURANCE
Most, if not all universities in the United States require that international students have health insurance. Most universities also offer low cost health insurance to their undergraduate and graduate students.


Many universities also require a medical examination before the student registers for classes. To find out what the specific requirements may be for the school you are interested in, you should contact either the admissions office or the Student Health Center. Most U.S. schools have a Student Health Center, or an organization with a similar name, with doctors and/or nurses available for students during specific times of the day. [ TOP ]

OBTAINING THE F-1 VISA
The student visa must be obtained at the nearest United States consulate to you. For the specific information as to hours of operation and/or local requirements, you should always contact the consulate before going. You can be ‘British’ in many ways, but only those people who have British Citizen passports are exempted from all of the UK’s immigration requirements. Most British Citizens are ‘British’ either by descent – because they have a British Citizen mother or father, OR they have been granted a Certificate of Naturalisation or Registration. With the possession of British Citizenship comes not only the ability to vote in all elections, and to stand for Parliament, but also the duties of a Citizen – a British Citizen may be called for jury service, or, in time of war, to join the armed services. If you want to become a British Citizen by virtue of close association with Britain – usually after lengthy residence, or through ancestry – then you may need to satisfy the authorities that you are a person of good character who has paid (or reached an accommodation concerning) your UK Tax and National Insurance liabilities, that you are not a threat to the UK’s national security and that you intend to continue to live in Britain or a British Colony.
